Terms of Service

These terms govern your use of ScreenWick, including the website at screenwick.com, the dashboard at screenwick.app and the TV player at screenwick.tv (together, the "Service"). ScreenWick is operated by iSmart Web, Houston, Texas ("we", "us"). By creating an account or using the Service you agree to these terms.

1. Accounts

You must be at least 18 and able to enter a contract for your business. You are responsible for your account, your users and everything done under your login. Keep passwords private and tell us at once about any unauthorized use.

2. The Service

ScreenWick lets you create and schedule content and play it on screens in your locations. We may improve, change or remove features. We aim for high availability but the Service is provided without a guaranteed uptime unless a separate written agreement says otherwise.

3. Plans, billing and renewals

  • Paid plans are billed in advance, monthly or for a prepaid term, through our payment processor (Stripe), or by check. Monthly plans renew automatically at the then-current price unless cancelled; prepaid terms do not renew.
  • Prices are in US dollars and exclude applicable taxes, which we may add.
  • If a payment fails, or a free trial ends without a plan, we may pause the product after a grace period. Your content is kept.
  • Discounts and promotional codes cannot be combined unless we say so, and may be withdrawn at any time.
  • Refunds and cancellation are described in our Refunds and cancellation policy.

4. Your content

You keep all rights to the images, videos, text and data you upload ("Your Content"). You give us a limited license to store, process and display Your Content only to provide the Service. You confirm you have the rights to Your Content and that it follows our Ad content policy and the law where your screens are. We may remove content or suspend screens that break these terms.

5. Acceptable use

Do not use the Service to show unlawful, infringing, deceptive, hateful or sexually explicit material; to break age-restriction rules for tobacco, vape, alcohol, cannabis/hemp or lottery products; to attack or overload our systems; or to resell the Service without a written partner agreement.

6. Devices and networks

You supply the TVs, devices and internet connections at your locations and are responsible for their installation, safety and power. Hardware we sell or supply is covered only by its manufacturer's warranty.

7. Partners and networks

If your account is provided by a partner, association or network, that organization may control parts of your account, content slots and billing under its own agreement with you and with us.

8. Confidentiality and data

We handle personal information as described in our Privacy Policy. You may export Your Content at any time while your account is active; after cancellation we may delete it after 30 days.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or lost profits or revenue. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Indemnity

You will defend and hold us harmless from claims arising from Your Content, your products or promotions, or your breach of these terms or the law.

12. Suspension and termination

You may cancel at any time. We may suspend or end accounts that break these terms, fail to pay, or put the Service or others at risk.

13. Changes

We may update these terms. For material changes we will notify account owners by email or in the dashboard at least 15 days before they take effect.

14. Governing law

These terms are governed by the laws of the State of Texas. Disputes will be resolved in the state or federal courts located in Harris County, Texas.
